By using PopTech Studio LLC services (“PopTech Studio,” “we,” “our,” or “us”) via poptechstudio.ai or any affiliated platform, and partner, you acknowledge and agree to be bound by these Terms of Service and our Privacy Policy.

Registration & Contact Communication Opt-In
By creating an account or accessing any PopTech Studio AI SaaS, product, or service, users explicitly agree to automatic registration for PopTech Studio communications. This opt-in includes important updates, feature releases, account notifications, service offers, and operational notices delivered via email.

Upon registration, users consent to receiving relevant information, product updates, onboarding materials, and periodic communications aligned with PopTech Studio’s mission to deliver measurable AI-powered business outcomes. All communications are designed in accordance with privacy standards and data protection practices, ensuring compliance with legal requirements and responsible use of personal data.

2. Use of Services

PopTech Studio provides AI-powered digital tools, assessments, and automation systems for business use. Services must not be used for:

• Medical, legal, or financial decision-making
• Harmful, unlawful, or deceptive activities
• Surveillance or discrimination

3. AI System & Output Governance

3.1 Limitations of AI Outputs
AI-generated outputs are informational only and may contain errors, hallucinations, or outdated content. You are solely responsible for validating content before use. We do not warrant the accuracy or fitness of AI outputs.

3.2 No Professional Advice
Outputs do not constitute legal, medical, or financial advice.

3.3 Output Ownership

• You retain rights to input data
• We own all AI models, prompt structures, and output templates
• Generated outputs are licensed non-exclusively and revocably for your internal use

3.4 Limitation of Liability for AI Outputs
PopTech Studio LLC is not liable for losses (direct or indirect) resulting from reliance on AI-generated content. This includes reputational harm, financial loss, or third-party claims.

3.5 Human Oversight & Ethics
We implement a human-in-the-loop system for mission-critical applications and adhere to ethical AI principles including transparency, accountability, and safety.

4. Data Security & Use

4.1 Data Security

• AES-256 encryption at rest and in transit
• SOC 2 Type II certified infrastructure
• 90-day activity logging
• $5M cyber liability insurance

4.2 Payment

• All payments are securely processed via PCI-DSS-compliant services
• Fees are non-refundable unless expressly stated in writing

4.3 Data Use

• We only use de-identified, aggregated metadata to improve user experience
• We do not use proprietary or customer-specific IP for model training without consent

5. Indemnification

You agree to indemnify, defend, and hold harmless PopTech Studio LLC and its affiliates from any claims, damages, or liabilities arising from your use of our services, your breach of these terms, or your violation of any third-party rights.

6. Dispute Resolution & Jurisdiction

• Governed by the laws of the State of Florida
• Binding arbitration in Miami-Dade County under AAA rules
• Class action waiver and jury trial waiver apply
• No legal claims may be brought unless they involve actual damages over $1,000 USD
• Injunctive relief carve-out: We reserve the right to seek equitable relief for IP or system misuse
